A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority to arrest a person without a warrant. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. This Act may be cited as the Citizens' Civil |
|
Liberties Act. |
|
SECTION 2. Article 14.01, Code of Criminal Procedure, is |
|
amended to read as follows: |
|
Art. 14.01. OFFENSE WITHIN VIEW. (a) A person who is a |
|
commissioned or noncommissioned security officer licensed under |
|
Chapter 1702, Occupations Code, and is engaged in the performance |
|
of the person's duties as a security officer [peace officer or any |
|
other person,] may, without a warrant, arrest an offender when the |
|
offense is committed in the person's [his] presence or within the |
|
person's [his] view, if the offense is one classed as a felony or as |
|
an offense against the public peace. |
|
(b) A peace officer may arrest an offender without a warrant |
|
for any offense committed in the peace officer's [his] presence or |
|
within the peace officer's [his] view. |
|
SECTION 3. This Act takes effect September 1, 2023. |
