A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notification requirements for law enforcement agencies |
|
|
regarding a missing child with an intellectual disability or mental |
|
|
illness. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 63, Code of Criminal Procedure, is |
|
|
amended by adding Article 63.0093 to read as follows: |
|
|
Art. 63.0093. NOTIFICATION REGARDING MISSING CHILD WITH |
|
|
INTELLECTUAL DISABILITY OR MENTAL ILLNESS. (a) In this article, |
|
|
"intellectual disability" and "mental illness" have the meanings |
|
|
assigned by Article 46B.001. |
|
|
(b) As soon as practicable after a law enforcement agency |
|
|
detains, arrests, or releases a missing child with an intellectual |
|
|
disability or mental illness, the agency shall notify the missing |
|
|
child's parent, managing conservator, or guardian regarding the |
|
|
agency's detention, arrest, or release. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
