A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of certain requirements regarding |
|
|
public school class size. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 25.112, Education Code, is amended by |
|
|
amending Subsection (d) and adding Subsection (g) to read as |
|
|
follows: |
|
|
(d) Subject to Subsection (g), on [On] application of a |
|
|
school district, the commissioner may except the district from the |
|
|
limit in Subsection (a) if the commissioner finds the limit works an |
|
|
undue hardship on the district. An exception expires at the end of |
|
|
the school year for which it is granted. |
|
|
(g) The commissioner may not grant an exception to the limit |
|
|
under Subsection (a) if the district has been assigned an overall |
|
|
performance rating of D or F under Section 39.054 for the preceding |
|
|
school year or for the most recent school year for which a |
|
|
performance rating was assigned. |
|
|
SECTION 2. This Act applies beginning with the 2023-2024 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
