A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the development and maintenance of a custody |
|
information system for certain offenders. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 66, Code of Criminal Procedure, is |
|
amended by adding Subchapter E-1 to read as follows: |
|
SUBCHAPTER E-1. CUSTODY INFORMATION SYSTEM |
|
Art. 66.221. CUSTODY INFORMATION SYSTEM. (a) The Texas |
|
Department of Criminal Justice shall collaborate with the |
|
Commission on Jail Standards to develop and maintain an online |
|
database for use by judges, prosecutors, and criminal defense |
|
attorneys in this state who are involved in the trial of a criminal |
|
offense. |
|
(b) The custody tracking system shall contain, for each |
|
offender under the supervision of the Texas Department of Criminal |
|
Justice or in the custody of a county jail in this state, the |
|
offender's: |
|
(1) name, including other names by which the offender |
|
is known; |
|
(2) date of birth; |
|
(3) date of arrest; |
|
(4) arrest charge, by offense code; and |
|
(5) date of expected release. |
|
(c) The Texas Department of Criminal Justice shall adopt |
|
rules necessary to implement this section, including rules: |
|
(1) limiting access to the judicial information system |
|
to individuals described by Subsection (a); |
|
(2) providing for the security and confidentiality of |
|
the information maintained in the custody information system; and |
|
(3) requiring the system to be updated in real time to |
|
reflect the location of each offender. |
|
(d) Each county jail in this state shall cooperate with the |
|
Texas Department of Criminal Justice in providing the information |
|
necessary for the department to maintain the custody information |
|
system. |
|
SECTION 2. This Act takes effect September 1, 2023. |
