A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to access to all prescribed medications by residents in |
|
certain long-term care facilities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle A, Title 4, Health and Safety Code, is |
|
amended by adding Chapter 226 to read as follows: |
|
CHAPTER 226. LONG-TERM CARE FACILITY RESIDENT RIGHT TO ACCESS |
|
PRESCRIPTION MEDICATION |
|
Sec. 226.001. DEFINITIONS. In this chapter: |
|
(1) "Long-term care facility" means: |
|
(A) a facility licensed or regulated under |
|
Chapter 242, 247, or 252, Health and Safety Code; or |
|
(B) a state supported living center as defined by |
|
Section 531.002, Health and Safety Code. |
|
(2) "Prescription" includes an entry in the |
|
compassionate-use registry established under Section 487.054. |
|
Sec. 226.002. RESIDENT RIGHT TO ACCESS PRESCRIPTION |
|
MEDICATION. A resident of a long-term care facility has a right to |
|
access any medication for which the resident has a prescription |
|
from a licensed practitioner, including a medication containing |
|
low-THC cannabis. |
|
SECTION 2. This Act takes effect September 1, 2023. |
