A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a waiver of rental application fees for certain |
|
|
persons. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 92, Property Code, is |
|
|
amended by adding Section 92.3516 to read as follows: |
|
|
Sec. 92.3516. WAIVER OF RENTAL APPLICATION FEES FOR CERTAIN |
|
|
PERSONS. (a) In this section, "homeless person" has the meaning |
|
|
assigned by 42 U.S.C. Section 11302. |
|
|
(b) A landlord or a landlord's agent may not charge an |
|
|
application fee to any homeless person in order to apply to lease a |
|
|
dwelling if the person provides acceptable proof of the person's |
|
|
homelessness, as prescribed by the Texas Department of Housing and |
|
|
Community Affairs by rule. |
|
|
SECTION 2. As soon as practicable after the effective date |
|
|
of this Act and not later than January 1, 2024, the Texas Department |
|
|
of Housing and Community Affairs shall adopt rules necessary to |
|
|
implement Section 92.3516, Property Code, as added by this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
