A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to reliability programs adopted by the Public Utility |
|
|
Commission of Texas for the ERCOT power region. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.159, Utilities Code, as added by |
|
|
Chapter 426 (S.B. 3), Acts of the 87th Legislature, Regular |
|
|
Session, 2021, is amended by adding Subsection (d) to read as |
|
|
follows: |
|
|
(d) The commission shall ensure that any commission program |
|
|
adopted to comply with the requirements of this section that |
|
|
assigns credits to or provides for capacity payments to generation |
|
|
facilities includes credits or payments available to nuclear and |
|
|
advanced nuclear generation facilities. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
