A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to the use of an electronic bulletin board to post public |
|
|
notice. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 551.050, Government Code, |
|
|
is amended to read as follows: |
|
|
Sec. 551.050. [MUNICIPAL GOVERNMENTAL BODY:] PLACE AND |
|
|
MEANS OF POSTING NOTICE. |
|
|
SECTION 2. Section 551.050, Government Code, is amended by |
|
|
adding Subsections (c) and (d) to read as follows: |
|
|
(c) The validity of a notice posted on an electronic |
|
|
bulletin board by a governmental body that made a good faith attempt |
|
|
to comply with the requirements of Section 551.043 is not affected |
|
|
by a failure to comply with a requirement of this section that is |
|
|
due to a technical problem beyond the governmental body's control. |
|
|
(d) If another law requires a governmental body to post |
|
|
notice, on a bulletin board or otherwise, the governmental body may |
|
|
comply with that law through the use of an electronic bulletin |
|
|
board. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
