A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the provision of full municipal services to a property |
|
|
in a municipality's extraterritorial jurisdiction following the |
|
|
municipality's denial of or refusal to permit an activity or |
|
|
structure on the property. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 42, Local Government Code, |
|
|
is amended by adding section 42.905to read as follows: |
|
|
(a) If a municipality extends the application of an |
|
|
ordinance to its area of extraterritorial jurisdiction and denies |
|
|
or refuses to permit an activity or structure in that area, the |
|
|
municipality shall provide the property on which the activity or |
|
|
structure is proposed the municipal services described by Section |
|
|
43.056(b) not later than 30 months after the date of the denial or |
|
|
refusal. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a municipal denial of or refusal to permit an activity or |
|
|
structure on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
