A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the sale of dogs or cats for a for-profit business. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sections 802.003(a) and (b), Occupations Code, |
|
|
are amended to read as follows: |
|
|
(a) Except as provided by Section 802.0031, this [This] |
|
|
chapter does not affect the applicability of any other law, rule, |
|
|
order, ordinance, or other legal requirement of the federal |
|
|
government, this state, or a political subdivision of this state. |
|
|
(b) Except as provided by Section 802.0031, this [This] |
|
|
chapter does not prevent a municipality or county from prohibiting |
|
|
or further regulating by order or ordinance the possession, |
|
|
breeding, or selling of dogs or cats. |
|
|
SECTION 2. Subchapter A, Chapter 802, Occupations Code, is |
|
|
amended by adding Section 802.0031 to read as follows: |
|
|
Sec. 802.0031. SALE OF DOG OR CAT BY FOR-PROFIT BUSINESS; |
|
|
PREEMPTION. A municipality or county may not adopt or enforce an |
|
|
ordinance, order, regulation, or similar measure that prohibits the |
|
|
sale of a dog or cat by a for-profit business otherwise in |
|
|
compliance with state law. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
