A BILL TO BE ENTITLED
 
AN ACT
  relating to the sale of dogs or cats for a for-profit business.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 802.003(a) and (b), Occupations Code,
  are amended to read as follows:
         (a)  Except as provided by Section 802.0031, this [This]
  chapter does not affect the applicability of any other law, rule,
  order, ordinance, or other legal requirement of the federal
  government, this state, or a political subdivision of this state.
         (b)  Except as provided by Section 802.0031, this [This]
  chapter does not prevent a municipality or county from prohibiting
  or further regulating by order or ordinance the possession,
  breeding, or selling of dogs or cats.
         SECTION 2.  Subchapter A, Chapter 802, Occupations Code, is
  amended by adding Section 802.0031 to read as follows:
         Sec. 802.0031.  SALE OF DOG OR CAT BY FOR-PROFIT BUSINESS;
  PREEMPTION.  A municipality or county may not adopt or enforce an
  ordinance, order, regulation, or similar measure that prohibits the
  sale of a dog or cat by a for-profit business otherwise in
  compliance with state law.
         SECTION 3.  This Act takes effect September 1, 2023.
