A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the referral of certain students receiving special |
|
|
education services to a local intellectual and developmental |
|
|
disability authority for services or public benefits. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 29, Education Code, is |
|
|
amended by adding Section 29.025 to read as follows: |
|
|
Sec. 29.025. REFERRAL TO LOCAL INTELLECTUAL AND |
|
|
DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer |
|
|
each student receiving special education services under this |
|
|
subchapter who has or is suspected to have an intellectual or |
|
|
developmental disability to a local intellectual and developmental |
|
|
disability authority for services or public benefits, including |
|
|
services under a Medicaid waiver program established under Section |
|
|
1915(c), Social Security Act (42 U.S.C. Section 1396n(c)). |
|
|
SECTION 2. This Act applies beginning with the 2023-2024 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
