A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the distribution of an application for a ballot to be |
|
|
voted by mail. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 84.0111(a), Election Code, is amended to |
|
|
read as follows: |
|
|
(a) An [Except as provided by Subsection (c) or as otherwise |
|
|
authorized by this code, an] officer or employee of this state or of |
|
|
a political subdivision of this state may not distribute an |
|
|
application form for an early voting ballot to a person who did not |
|
|
request an application under Section 84.001. |
|
|
SECTION 2. Section 84.0111(c), Election Code, is repealed. |
|
|
SECTION 3. The changes in law made by this Act apply to an |
|
|
application form for an early voting ballot distributed on or after |
|
|
the effective date of this Act. The distribution of an application |
|
|
form for an early voting ballot before the effective date of this |
|
|
Act is governed by the law in effect on the date the application was |
|
|
distributed, and the former law is continued in effect for that |
|
|
purpose. |

|
SECTION 4. This Act takes effect September 1, 2023. |
