A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain special purpose districts to |
|
|
impose impact fees in certain areas. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 395.011, Local Government Code, is |
|
|
amended by adding Subsection (b-1) to read as follows: |
|
|
(b-1) In addition to an area authorized under Subsection |
|
|
(b), a district or authority created under Section 52, Article III, |
|
|
or Section 59, Article XVI, Texas Constitution, may enact or impose |
|
|
impact fees in an area in which the district or authority may |
|
|
provide water or sewer services under a certificate of public |
|
|
convenience and necessity issued under Chapter 13, Water Code. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
