A BILL TO BE ENTITLED
 
AN ACT
  relating to the provision of emergency services in an emergency
  services district by the district and other providers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 775.031, Health and Safety Code, is
  amended by adding Subsections (f) and (g) to read as follows:
         (f)  Except as provided by Subsection (g) of this section,
  Subchapter B, and Section 775.032, a district has the exclusive
  authority to determine whether another person may provide services
  in the district that the district is authorized to provide,
  including when the district's territory overlaps with the territory
  of another political subdivision authorized to provide services
  that the district is authorized to provide.
         (g)  A district may not prohibit a county or municipality
  from providing services in the district under Subsection (f) if:
               (1)  the territory in the district overlaps with the
  boundaries of the county or municipality; and
               (2)  the county or municipality began providing the
  services to the territory in the district before:
                     (A)  January 1, 2023; or
                     (B)  the date the district was created, for a
  district created on or after January 1, 2023.
         SECTION 2.  Section 775.036, Health and Safety Code, is
  amended by adding Subsection (h) to read as follows:
         (h)  The board shall:
               (1)  post a map on the district's Internet website
  displaying the territory of each authorized emergency service
  provider in the district; and
               (2)  provide a copy of the map described by Subdivision
  (1) to:
                     (A)  each political subdivision that overlaps
  with the boundaries of the district; and
                     (B)  each public safety answering point, as
  defined by Section 772.001, that serves the district.
         SECTION 3.  The change in law made by this Act applies only
  to services provided under a contract entered into on or after the
  effective date of this Act. Services provided under a contract
  entered into before the effective date of this Act are governed by
  the law in effect on the date the contract was entered into, and the
  former law is continued in effect for that purpose.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
