A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to certain powers and duties of a drainage district. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 56.111, Water Code, is amended to read as |
|
follows: |
|
Sec. 56.111. CONTROL AND REPAIR OF DISTRICT IMPROVEMENTS. |
|
(a) The board may control and supervise the construction and |
|
maintenance of canals, drains, ditches and levees, and other |
|
improvements of the district and shall keep them in repair. |
|
(b) Notwithstanding any other law, a district described by |
|
this subsection may control, supervise, finance, purchase, |
|
construct, acquire, own, operate, maintain, repair, improve, and |
|
extend inside and outside its boundaries any works, improvements, |
|
facilities, plants, equipment, and appliances necessary to |
|
accomplish the creation and operation of a stormwater reclamation |
|
system and may issue related bonds. This subsection applies only to |
|
a district located in a county that is located adjacent to the |
|
United Mexican States, has a population of more than 800,000, and |
|
contains at least two municipalities each of which has a population |
|
of 70,000 or more. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
