A BILL TO BE ENTITLED
 
AN ACT
  relating to the security of the electricity supply chain.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Subchapter F, Chapter 38,
  Utilities Code, is amended to read as follows:
  SUBCHAPTER F. [TEXAS] ELECTRICITY SUPPLY CHAIN SECURITY AND MAPPING
  [COMMITTEE]
         SECTION 2.  Section 38.201(c), Utilities Code, is amended to
  read as follows:
         (c)  The committee is composed of:
               (1)  the executive director of the commission;
               (2)  the executive director of the Railroad Commission
  of Texas;
               (3)  the president and the chief executive officer of
  the independent organization certified under Section 39.151 for the
  ERCOT power region; [and]
               (4)  the public safety director of the Department of
  Public Safety; and
               (5)  the chief of the Texas Division of Emergency
  Management.
         SECTION 3.  Subchapter F, Chapter 38, Utilities Code, is
  amended by adding Section 38.205 to read as follows:
         Sec. 38.205.  PHYSICAL SECURITY OF SUBSTATIONS. (a) The
  commission shall require each electric cooperative, municipally
  owned utility, and transmission and distribution utility to include
  in the cooperative's or utility's emergency operations plan
  described by Section 186.007 information about the physical
  security of the cooperative's or utility's critical substations and
  contact information for each law enforcement agency with
  jurisdiction over the critical substations.
         (b)  The commission shall provide the Department of Public
  Safety with access to the information described by Subsection (a).
         (c)  Information provided to the commission or the
  Department of Public Safety under this section is confidential
  under Section 418.181, Government Code, and not subject to
  disclosure under Chapter 552, Government Code.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
