A BILL TO BE ENTITLED
 
AN ACT
  relating to the creation of a bulk ammunition database.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 411, Government Code, is amended by
  adding Subchapter S to read as follows:
  SUBCHAPTER S
  BULK AMMUNITION DATABASE
         Sec. 411.601.  DEFINITIONS. In this subchapter:
               (1)  "ammunition" means any cartridge, shell, or
  projectile intended for use in a firearm;
               (2)  "bulk purchase" means the purchase of 200 or more
  rounds of ammunition at one time; and
               (3)  "database" means the bulk ammunition database
  established under this statute.
         Sec. 411.602.  BULK AMMUNITION DATABASE. (a) All persons
  selling ammunition in quantities greater than 200 rounds shall
  register with the database and provide information on the sale,
  including the date of sale, the name and address of the purchaser,
  and the type and quantity of ammunition sold.
         (b)  All persons purchasing ammunition in quantities greater
  than 200 rounds shall provide their name and address to the seller,
  who shall forward this information to the database.
         (c)  The database shall be maintained by the department and
  shall be accessible to law enforcement for the purpose of verifying
  the legality of ammunition sales.
         Sec. 411.603.  REQUIREMENTS FOR CERTAIN AMMUNITION
  PURCHASES. (a) All persons purchasing ammunition in quantities
  greater than 200 rounds shall undergo a background check prior to
  the sale. The background check shall be performed by a licensed
  firearms dealer and shall include a check of the National Instant
  Criminal Background Check System (NICS) and any other relevant
  databases.
         (b)  The seller shall verify that the background check has
  been completed and that the purchaser is not prohibited from
  possessing ammunition before making the sale.
         Sec. 411.604.  CRIMINAL PENALTIES. (a) Any person who
  knowingly violates the provisions of this subchapter shall be
  guilty of a Class A misdemeanor.
         (b)  Any person who knowingly makes a false statement on a
  bulk ammunition sale form shall be guilty of a third degree felony.
         SECTION 2.  This Act takes effect September 1, 2023.
