A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirements for the purchase of ammunition;
  creating an offense.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Government Code, is amended by
  adding Section 411.210 to read as follows:
         Sec. 411.210.  PURCHASES AND SALES OF AMMUNITION. (a) In
  this section "ammunition" means any cartridge, shell, or projectile
  intended for use in a firearm.
         (b)  A person commits an offense if the person intentionally
  or knowingly sells ammunition and the person accepts anything other
  than the following as payment for the ammunition:
               (1)  United States currency;
               (2)  a negotiable instrument in the form of a check that
  meets the requirements of Section 3.104, Business & Commerce Code;
  and
               (3)  a debit made through a financial institution debit
  card.
         (c)  A person commits an offense if the person intentionally
  or knowingly sells ammunition for a firearm to a person who is
  younger than 18 years of age.
         (d)  A person commits an offense if the person intentionally
  or knowingly sells ammunition for a firearm to a person without
  verifying the age of the purchaser by examining a driver's license
  or identification card issued by the state or by the United States
  government, a passport, or other government-issued documentation
  that provides the person's name, date of birth, and photograph.
         (e)  An offense under this section is a Class A misdemeanor.
         SECTION 2.  This Act takes effect September 1, 2023.
