A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of certain collective bargaining laws |
|
|
to certain public school employees, school districts, and |
|
|
open-enrollment charter schools. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 21, Education Code, is |
|
|
amended by adding Section 21.416 to read as follows: |
|
|
Sec. 21.416. APPLICABILITY OF CERTAIN COLLECTIVE |
|
|
BARGAINING LAWS. (a) In this section: |
|
|
(1) "public employer" has the meaning assigned by |
|
|
Section 174.003, Local Government Code. |
|
|
(2) "Teacher" means: |
|
|
(A) an educator; or |
|
|
(B) a classroom teacher employed by an |
|
|
open-enrollment charter school. |
|
|
(b) Notwithstanding any other law to the contrary, a teacher |
|
|
is entitled to organize and bargain collectively and a teacher and a |
|
|
school district or open-enrollment charter school, as applicable, |
|
|
that employs the teacher are subject to the same requirements |
|
|
provided under Chapter 174, Local Government Code. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a contract entered into or renewed on or after the effective date |
|
|
of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
