A BILL TO BE ENTITLED
 
AN ACT
  relating to the applicability of certain collective bargaining laws
  to certain public school employees, school districts, and
  open-enrollment charter schools.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter I, Chapter 21, Education Code, is
  amended by adding Section 21.416 to read as follows:
         Sec. 21.416.  APPLICABILITY OF CERTAIN COLLECTIVE
  BARGAINING LAWS. (a) In this section:
               (1)  "public employer" has the meaning assigned by
  Section 174.003, Local Government Code.
               (2)  "Teacher" means:
                     (A)  an educator; or
                     (B)  a classroom teacher employed by an
  open-enrollment charter school.
         (b)  Notwithstanding any other law to the contrary, a teacher
  is entitled to organize and bargain collectively and a teacher and a
  school district or open-enrollment charter school, as applicable,
  that employs the teacher are subject to the same requirements
  provided under Chapter 174, Local Government Code.
         SECTION 2.  The change in law made by this Act applies only
  to a contract entered into or renewed on or after the effective date
  of this Act.
         SECTION 3.  This Act takes effect September 1, 2023.
