A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Aransas County Navigation District |
|
|
to enter into certain leases. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5001.101, Special District Local Laws |
|
|
Code, is amended to read as follows: |
|
|
Sec. 5001.101. PURCHASE OR LEASE OF PROPERTY. (a) Except |
|
|
as provided by Subsections (b) and (c), the [The] district may |
|
|
purchase or lease property in the same manner as a county. |
|
|
(b) The district may lease the surface of land, including |
|
|
submerged land, for not more than 90 years. The lease may not be |
|
|
extended beyond the 90-year period by renewal, extension, or |
|
|
otherwise. |
|
|
(c) The district may not enter into or extend a lease of |
|
|
property under this section for use in: |
|
|
(1) the conduct of gaming or wagering activities |
|
|
authorized under Subtitles A and A-1, Title 13, Occupations Code; |
|
|
(2) the conduct of gambling prohibited under Chapter |
|
|
47, Penal Code; or |
|
|
(3) the establishment of a casino or other similar |
|
|
gaming facility. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
