A JOINT RESOLUTION
|
|
proposing a constitutional amendment to authorize the legislature |
|
to exempt from ad valorem taxation property used to control |
|
pollution, regardless of whether the property is used to meet or |
|
exceed rules or regulations adopted for that purpose. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1-l(a), Article VIII, Texas |
|
Constitution, is amended to read as follows: |
|
(a) The legislature by general law may exempt from ad |
|
valorem taxation all or part of real and personal property used, |
|
constructed, acquired, or installed wholly or partly to prevent, |
|
monitor, control, or reduce [meet or exceed rules or regulations |
|
adopted by any environmental protection agency of the United |
|
States, this state, or a political subdivision of this state for the |
|
prevention, monitoring, control, or reduction of] air, water, or |
|
land pollution. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 7, 2023. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment to authorize the |
|
legislature to exempt from ad valorem taxation property used to |
|
control pollution, regardless of whether the property is used to |
|
meet or exceed rules or regulations adopted for that purpose." |
