A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment regarding public free schools |
|
|
and prohibiting certain state regulation regarding private |
|
|
educational settings. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1, Article VII, Texas Constitution, is |
|
|
amended to read as follows: |
|
|
Sec. 1. (a) A general diffusion of knowledge being |
|
|
essential to the preservation of the liberties and rights of the |
|
|
people, it shall be the duty of the Legislature of the State to |
|
|
establish, ensure public oversight of, and make suitable provision |
|
|
for the support and maintenance of an efficient system of public |
|
|
free schools. |
|
|
(b) Each child of school age who resides in this state is |
|
|
entitled to access, with the consent of the child's parent, a public |
|
|
free school. |
|
|
(c) The state may not: |
|
|
(1) abridge the right of a parent to place the parent's |
|
|
child in an educational setting of the parent's choice outside of |
|
|
the public free schools; or |
|
|
(2) regulate the provision of education in an |
|
|
educational setting for which the state does not provide support or |
|
|
maintenance. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 7, 2023. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment regarding public free |
|
|
schools and prohibiting certain state regulation regarding private |
|
|
educational settings." |
