A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to the establishment of a boil water notice alert system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 341, Health and Safety |
|
|
Code, is amended by adding Section 341.043 to read as follows: |
|
|
Sec. 341.043. BOIL WATER NOTICE ALERT SYSTEM. (a) The |
|
|
commission shall develop and implement an alert system to be |
|
|
activated in the event of a boil water notice and any related |
|
|
information, including any recission or expiration of the boil |
|
|
water notice. |
|
|
(b) The alert system must include the ability to provide |
|
|
notifications through electronic instant messaging. |
|
|
(c) The commission may adopt rules and procedures necessary |
|
|
to implement this section. |
|
|
SECTION 2. As soon as practicable after the effective date |
|
|
of this Act, the Texas Commission on Environmental Quality shall |
|
|
establish the alert system required by Section 341.043, Health and |
|
|
Safety Code, as added by this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
