A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring public institutions of higher education to
  make available to students certain pregnancy-related informational
  materials published by the Department of State Health Services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
  amended by adding Section 51.9196 to read as follows:
         Sec. 51.9196.  REQUIRED INFORMATION FOR STUDENTS RELATED TO
  PREGNANCY RESOURCES. (a) In this section:
               (1)  "Institution of higher education" has the meaning
  assigned by Section 61.003.
               (2)  "QR code" has the meaning assigned by Section
  443.001, Health and Safety Code.
         (b)  The student health center of each institution of higher
  education shall:
               (1)  make available at no cost to students the
  informational materials described by Section 171.014, Health and
  Safety Code, in a printed format; and
               (2)  post in a conspicuous location at the student
  health center a sign containing a QR code that may be scanned and
  that leads to the Internet website described by Section 171.014(e),
  Health and Safety Code.
         (c)  The executive commissioner of the Health and Human
  Services Commission by rule shall prescribe the design and content
  of the sign required to be posted under this section.
         SECTION 2.  Not later than January 15, 2024, the executive
  commissioner of the Health and Human Services Commission shall
  adopt rules as required by Section 51.9196(c), Education Code, as
  added by this Act.
         SECTION 3.  This Act applies beginning with the 2024 spring
  semester.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
