A BILL TO BE ENTITLED
 
AN ACT
  relating to the eligibility of certain political subdivisions to
  receive certain financial assistance administered by the Texas
  Water Development Board.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 15.001, Water Code, is amended by adding
  Subdivision (14) to read as follows:
               (14)  "Rural political subdivision" means:
                     (A)  a nonprofit water supply or sewer service
  corporation, district, or municipality that:
                           (i)  has a service area with a population of
  10,000 or less no part of which is located in an urban area as
  defined by the United States Bureau of the Census; or
                           (ii)  otherwise qualifies for financing from
  a federal agency; or
                     (B)  a county in which no urban area has a
  population of more than 50,000.
         SECTION 2.  Section 17.001, Water Code, is amended by adding
  Subdivision (26) to read as follows:
               (26)  "Rural political subdivision" means:
                     (A)  a nonprofit water supply or sewer service
  corporation, district, or municipality that:
                           (i)  has a service area with a population of
  10,000 or less no part of which is located in an urban area as
  defined by the United States Bureau of the Census; or
                           (ii)  otherwise qualifies for financing from
  a federal agency; or
                     (B)  a county in which no urban area has a
  population of more than 50,000.
         SECTION 3.  Section 17.9615(a), Water Code, is amended to
  read as follows:
         (a)  The board may direct the comptroller to transfer amounts
  from the financial assistance account to the rural water assistance
  fund to provide financial assistance to rural political
  subdivisions under this subchapter for the purposes provided in
  Section 15.994.
         SECTION 4.  Section 15.992(4), Water Code, is repealed.
         SECTION 5.  This Act takes effect September 1, 2023.
