A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the regulation of certain pharmacies. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 562, Occupations Code, is |
|
|
amended by adding Section 562.113 to read as follows: |
|
|
Sec. 562.113. WEEKEND OPERATING HOURS. (a) A person who |
|
|
owns 50 or more pharmacies licensed under this subtitle and located |
|
|
in this state shall ensure that each location is open for the |
|
|
provision of pharmacy services to the public for not less than six |
|
|
total hours each weekend, other than a weekend that includes a |
|
|
federal holiday. |
|
|
(b) Notwithstanding Section 566.001, the board may impose |
|
|
an administrative penalty on a person for the fourth and each |
|
|
subsequent violation of Subsection (a) in a calendar year at a |
|
|
pharmacy location owned by the person. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
