A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to term limitation for United States Senators from Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 145, Election Code, is amended by adding |
|
new section 145.040 to read as follows: |
|
Sec. 145.040. UNITED STATES SENATE CANDIDATE ELIGIBILITY. |
|
No person who has served two terms as a United States Senator shall |
|
be eligible for election or appointment to the United States Senate |
|
from Texas. For purposes of this section, the election or |
|
appointment of a person to fill a vacancy in the United States |
|
Senate shall be included as one term in determining the number of |
|
terms that such person has served as a United States Senator if the |
|
person fills the vacancy for more than three years. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
