A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to vehicle monitoring technology installed on certain |
|
motor vehicles. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter N, Chapter 2301, Occupations Code, is |
|
amended by adding Section 2301.655 to read as follows: |
|
Sec. 2301.655. VEHICLE MONITORING TECHNOLOGY. (a) In this |
|
section: |
|
(1) "Light truck" and "passenger car" have the |
|
meanings assigned by Section 541.201, Transportation Code. |
|
(2) "Vehicle monitoring technology" means any |
|
application or device, including software, firmware, or hardware, |
|
that, when activated or engaged, monitors the operator or operation |
|
of a motor vehicle on which it is installed. |
|
(b) The board may take an action described by Section |
|
2301.651 against a license holder under this chapter who: |
|
(1) manufactures, distributes, or possesses with |
|
intent to distribute vehicle monitoring technology that is: |
|
(A) installed or intended to be installed on a |
|
light truck or passenger car; and |
|
(B) not capable of being deactivated or |
|
disengaged by the vehicle's operator; |
|
(2) installs on a light truck or passenger car vehicle |
|
monitoring technology that is not capable of being deactivated or |
|
disengaged by the vehicle's operator; or |
|
(3) sells a light truck or passenger car on which has |
|
been installed vehicle monitoring technology that is not capable of |
|
being deactivated or disengaged by the vehicle's operator. |
|
SECTION 2. Section 2301.655, Occupations Code, as added by |
|
this Act, applies only to disciplinary action under Section |
|
2301.651, Occupations Code, against a license holder for conduct |
|
that occurs on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2023. |
