A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the eligibility of certain officers of a political |
|
|
subdivision authorized to impose a tax or issue bonds to hold at the |
|
|
same time certain other offices. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 180, Local Government Code, is amended |
|
|
by adding Section 180.0055 to read as follows: |
|
|
Sec. 180.0055. ELIGIBILITY OF CERTAIN ELECTED OR APPOINTED |
|
|
OFFICERS TO HOLD CERTAIN OTHER OFFICES. (a) This section applies |
|
|
only to an elected or appointed office of a political subdivision |
|
|
authorized to impose a tax or issue bonds. This section applies only |
|
|
to the extent it does not conflict with a provision of the state |
|
|
constitution. |
|
|
(b) An officer who holds an office to which this section |
|
|
applies is not eligible to hold at the same time another office to |
|
|
which this section applies. |
|
|
SECTION 2. Not later than the effective date of this Act, an |
|
|
officer who holds more than one office in violation of Section |
|
|
180.0055, Local Government Code, as added by this Act, shall |
|
|
resign, effective on that date, from each office necessary to allow |
|
|
the officer to be in compliance with the requirement of that |
|
|
section. |

SECTION 3. This Act takes effect September 1, 2023. |
