A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requiring public schools to make reasonable |
|
|
accommodations for lactating students. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|
|
amended by adding Section 38.041 to read as follows: |
|
|
Sec. 38.041. ACCOMMODATIONS FOR LACTATING STUDENTS. The |
|
|
board of trustees of each school district, the governing boards of |
|
|
the Texas School for the Blind and Visually Impaired and the Texas |
|
|
School for the Deaf, and the governing body of each open-enrollment |
|
|
charter school shall provide reasonable accommodations to a |
|
|
lactating student enrolled at the middle or high school level to |
|
|
enable the student to: |
|
|
(1) express breast milk; |
|
|
(2) breast-feed an infant child; and |
|
|
(3) address other needs related to breast-feeding. |
|
|
SECTION 2. This Act applies beginning with the 2023-2024 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
