A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the disclosure of potential conflicts of interest by |
|
|
certain school district employees or officials and a prohibition on |
|
|
certain school districts from entering into certain contracts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 44, Education Code, is |
|
|
amended by adding Section 44.0314 to read as follows: |
|
|
Sec. 44.0314. APPLICABILITY OF REQUIREMENTS AND |
|
|
PROHIBITIONS REGARDING CONFLICTS OF INTEREST. (a) Except as |
|
|
provided by Subsection (b), Section 2261.252, Government Code, |
|
|
applies to a school district as if the district were a state agency, |
|
|
and to a district employee or official as if the employee or |
|
|
official were a state agency employee or official, to the extent |
|
|
that that section does not conflict with this code. |
|
|
(b) This section does not apply to a school district, or to |
|
|
an employee or official of the district, that is classified by the |
|
|
agency as: |
|
|
(1) rural; |
|
|
(2) non-metropolitan: stable; or |
|
|
(3) independent town. |
|
|
SECTION 2. Section 44.0314, Education Code, as added by |
|
|
this Act, applies only to a contract entered into on or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
