A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of certain laws to assistance |
|
|
provided to an individual in obtaining an abortion outside of this |
|
|
state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 170A.002, Health and Safety Code, is |
|
|
amended by adding Subsection (e) to read as follows: |
|
|
(e) Direct or indirect assistance provided to an individual |
|
|
for traveling outside of this state to obtain an abortion does not |
|
|
constitute a violation of this section. |
|
|
SECTION 2. Subchapter A, Chapter 171, Health and Safety |
|
|
Code, is amended by adding Section 171.009 to read as follows: |
|
|
Sec. 171.009. ASSISTANCE WITH OUT-OF-STATE TRAVEL. |
|
|
Notwithstanding any other law, a person may provide direct or |
|
|
indirect assistance to an individual for traveling outside of this |
|
|
state to obtain an abortion. |
|
|
SECTION 3. Section 171.208, Health and Safety Code, is |
|
|
amended by adding Subsection (a-1) to read as follows: |
|
|
(a-1) A civil action under Subsection (a)(2) or (3) may not |
|
|
be brought against a person for providing or intending to provide |
|
|
direct or indirect assistance to an individual for traveling |
|
|
outside of this state to obtain an abortion. |
|
|
SECTION 4. This Act takes effect September 1, 2023. |
