A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an allotment for day placement programs under the |
|
Foundation School Program. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter G, Chapter 48, Education Code, is |
|
amended by adding Section 48.307 to read as follows: |
|
Sec. 48.307. DAY PLACEMENT PROGRAM FUNDING. (a) For each |
|
qualifying day placement program that a regional education service |
|
center makes available in partnership with a school district, |
|
open-enrollment charter school, or shared services arrangement, |
|
the center is entitled to an allotment of: |
|
(1) $250,000 for the first year of the program's |
|
operation; and |
|
(2) $150,000 for each year of the program's operation |
|
after the first year. |
|
(b) A day placement program qualifies for purposes of |
|
Subsection (a) if: |
|
(1) the program complies with commissioner rules |
|
regarding contracts for the placement of students receiving special |
|
education services in a day placement program; |
|
(2) the program offers services to students who are |
|
enrolled at any school district or open-enrollment charter school |
|
in the county in which the program is offered, unless the |
|
commissioner by rule waives or modifies the requirement under this |
|
subdivision for the program to serve all students in a county; and |
|
(3) the agency has designated the program for service |
|
in the county in which the program is offered. |
|
SECTION 2. This Act takes effect September 1, 2023. |
