A BILL TO BE ENTITLED
 
AN ACT
  relating to the sale of certain alcoholic beverages to ultimate
  consumers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle A, Chapter 14, Alcoholic Beverage Code,
  is amended by adding Subsection 14.05(h) to read as follows:
         Sec. 14.05(h)  The holder of a distiller's and rectifier's
  permit may sell distilled spirits manufactured by the permit holder
  to ultimate consumers who reside outside the state of Texas without
  the limitation of subsection (c) if:
         (1)  The permit holder checks a purchaser's identification
  and keep records of purchases in a manner that enables the permit
  holder to verify the consumer is not a resident of Texas;
         (2)  the sale for off-premises consumption is in unbroken
  packages containing not more than 750 milliliters of distilled
  spirits in an amount not to exceed 3,500 gallons annually;
         (3)  the sale is to an individual who is physically present
  at the permit holder's premises.
         SECTION 2.  This Act takes effect on September 1, 2023.
