A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the composition of a county election board. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 51.002, Election Code, is amended by |
|
|
amending Subsection (b) and adding Subsection (b-1) to read as |
|
|
follows: |
|
|
(b) For the general election for state and county officers |
|
|
and for a special election for an officer regularly elected at the |
|
|
general election, the county election board consists of the |
|
|
following members: |
|
|
(1) the county judge; |
|
|
(2) the[,] county clerk; |
|
|
(3) the[,] voter registrar; |
|
|
(4) the[,] sheriff; |
|
|
(5) the[, and] county chair of each political party |
|
|
required to nominate candidates by primary election; and |
|
|
(6) as a nonvoting member, the county elections |
|
|
administrator, if applicable. |
|
|
(b-1) For an election other than an election described by |
|
|
Subsection (b) [other elections], the board consists of the |
|
|
following members: |
|
|
(1) the county judge; |
|
|
(2) the[,] county clerk; |
|
|
(3) the[,] voter registrar; |
|
|
(4) the[, and] sheriff; and |
|
|
(5) as a nonvoting member, the county elections |
|
|
administrator, if applicable. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
