AN ACT
  relating to public acknowledgment of donations made to the Texas
  Department of Transportation.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 201.206, Transportation Code, is amended
  to read as follows:
         Sec. 201.206.  DONATIONS AND CONTRIBUTIONS. (a) For the
  purpose of carrying out its functions and duties, the department
  may accept, from any source, a donation or contribution in any form,
  including realty, personalty, money, materials, or services.
         (b)  The department may enter into an agreement with a donor
  to publicly acknowledge donations made to the department. The
  public acknowledgment may not contain comparative or qualitative
  descriptions of the donor's products, services, facilities, or
  companies.
         (c)  If a person makes a donation to the department's
  roadside assistance and safety service patrol program, the
  department may post an acknowledgment of the donation on a vehicle
  or equipment the department uses for the program.
         (d)  The commission may adopt rules for the acknowledgment of
  donations under this section.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
