A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to public acknowledgment of donations made to the Texas |
|
Department of Transportation. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 201.206, Transportation Code, is amended |
|
to read as follows: |
|
Sec. 201.206. DONATIONS AND CONTRIBUTIONS. (a) For the |
|
purpose of carrying out its functions and duties, the department |
|
may accept, from any source, a donation or contribution in any form, |
|
including realty, personalty, money, materials, or services. |
|
(b) The department may enter into an agreement with a donor |
|
to publicly acknowledge donations made to the department. The |
|
public acknowledgment may not contain comparative or qualitative |
|
descriptions of the donor's products, services, facilities, or |
|
companies. |
|
(c) If a person makes a donation to the department's |
|
roadside assistance and safety service patrol program, the |
|
department may post an acknowledgment of the donation on a vehicle |
|
or equipment the department uses for the program. |
|
(d) The commission may adopt rules for the acknowledgment of |
|
donations under this section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
