A BILL TO BE ENTITLED
 
AN ACT
  relating to a policy adopted by school districts allowing parent
  volunteers on school district campuses.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 26, Education Code, is amended by adding
  Section 26.016 to read as follows:
         Sec. 26.016.  PARENT VOLUNTEERS. (a)  In this section,
  "parent volunteer" means a parent or guardian of a student enrolled
  in the school district.
         (b)  Each school district shall adopt a policy to allow and
  encourage parent volunteers at each campus in the district. The
  policy:
               (1)  must allow a parent volunteer to volunteer on the
  campus in the district in which the parent volunteer's child is
  enrolled; 
               (2)  must require the parent volunteer to provide the
  documents needed for the district to perform a criminal history
  background check as provided by Section 22.0835;
               (3)  must require the school district to develop and
  implement training for parent volunteers that:
                     (A)  ensures parent volunteers do not interfere
  with instructional time; and 
                     (B)  includes guidelines for parent volunteers to
  follow while at a campus in the district;
               (4)  must require a parent volunteer to complete the
  training described by Subdivision (3) before the parent volunteer
  is allowed to volunteer; 
               (5)  may only prohibit parent volunteers from being
  present on the campus in the district in which the parent
  volunteer's child is enrolled during the administration of a
  standardized test; 
               (6)  may not prohibit parent volunteers from
  volunteering if the parent volunteer has filed a grievance or
  complaint against the district; and
               (7)  must require the school district to create and
  maintain an Internet portal that:
                     (A)  allows parent volunteers to submit
  information for the district to complete a criminal history
  background check;
                     (B)  informs parent volunteers of volunteer
  opportunities; and 
                     (C)  allows parent volunteers to register for
  volunteer opportunities.
         SECTION 2.  As soon as practicable after the effective date
  of this Act, each school district shall adopt a policy required by
  Section 26.016, Education Code, as added by this Act.
         SECTION 3.  This Act applies beginning with the 2023-2024
  school year.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
