A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an adjustment of the average daily attendance of a |
|
school district with a certain student attendance rate. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 48.005, Education Code, is amended by |
|
adding Subsection (a-1) to read as follows: |
|
(a-1) Notwithstanding any other adjustment to average daily |
|
attendance to which a school district may be entitled under this |
|
section, for a school year in which a district's student attendance |
|
rate is less than the average of the district's student attendance |
|
rate for the preceding three school years, the commissioner shall |
|
adjust the average daily attendance of the district by multiplying |
|
the district's average daily attendance by an amount equal to the |
|
quotient of the average of the district's student attendance rate |
|
for the preceding three school years divided by the district's |
|
student attendance rate. For purposes of this subsection: |
|
(1) the district's student attendance rate is the |
|
quotient of the sum of attendance by students in membership for |
|
purposes of average daily attendance for each day of the minimum |
|
number of days of instruction as described under Section 25.081(a) |
|
divided by the sum of the number of days of the minimum number of |
|
days of instruction for which those students are in membership; and |
|
(2) in calculating the district's student attendance |
|
rate for the preceding three school years, the commissioner shall |
|
use the three most recent preceding school years excluding any |
|
school year during which a statewide disaster declaration was |
|
issued by the governor under Chapter 418, Government Code. |
|
SECTION 2. This Act takes effect September 1, 2023. |
