A BILL TO BE ENTITLED
 
AN ACT
  relating to banning the transfer, distribution, sale of bump-fire
  stock; creating a criminal offense;.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 46, Penal Code, is amended by adding new
  Section 46.16 to read as follow:
         Sec. 46.16.  BUMP-STOCK CONVERSION KITS PROHIBITED. (a) A
  person may not import into this state or transfer, distribute,
  sell, keep for sale, offer for sale, possess, or give to another
  person a bump-fire stock. 
         (b)  A person who violates this section commits a Class A
  Misdemeanor. 
         (c)  As used in this section, the term "bump-fire stock"
  means a conversion kit, a tool, an accessory, or a device used to
  alter the rate of fire of a firearm to mimic automatic weapon fire
  or which is used to increase the rate of fire to a faster rate than
  is possible for a person to fire such semiautomatic firearm
  unassisted by a kit, a tool, an accessory, or a device.
         SECTION 2.  The changes in law made by this Act apply only to
  an offense committed on or after the effective date of this Act. An
  offense committed before the effective date of this Act is governed
  by the law in effect on the date the offense was committed, and the
  former law is continued in effect for that purpose. For purposes of
  this subsection, an offense was committed before the effective date
  of this Act if any element of the offense was committed before that
  date.
         SECTION 3.  This Act takes effect September 1, 2023.
