A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to banning the transfer, distribution, sale of bump-fire |
|
stock; creating a criminal offense;. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 46, Penal Code, is amended by adding new |
|
Section 46.16 to read as follow: |
|
Sec. 46.16. BUMP-STOCK CONVERSION KITS PROHIBITED. (a) A |
|
person may not import into this state or transfer, distribute, |
|
sell, keep for sale, offer for sale, possess, or give to another |
|
person a bump-fire stock. |
|
(b) A person who violates this section commits a Class A |
|
Misdemeanor. |
|
(c) As used in this section, the term "bump-fire stock" |
|
means a conversion kit, a tool, an accessory, or a device used to |
|
alter the rate of fire of a firearm to mimic automatic weapon fire |
|
or which is used to increase the rate of fire to a faster rate than |
|
is possible for a person to fire such semiautomatic firearm |
|
unassisted by a kit, a tool, an accessory, or a device. |
|
SECTION 2. The changes in law made by this Act apply only to |
|
an offense committed on or after the effective date of this Act. An |
|
offense committed before the effective date of this Act is governed |
|
by the law in effect on the date the offense was committed, and the |
|
former law is continued in effect for that purpose. For purposes of |
|
this subsection, an offense was committed before the effective date |
|
of this Act if any element of the offense was committed before that |
|
date. |
|
SECTION 3. This Act takes effect September 1, 2023. |
