A BILL TO BE ENTITLED
 
AN ACT
  relating to the establishment and operation of a mobile narcotic
  drug treatment unit by a narcotic drug treatment program facility;
  authorizing a fee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1. Chapter 466, Health and Safety Code, is amended by
  adding Subchapter B-1 to read as follows:
  SUBCHAPTER B-1.  MOBILE NARCOTIC DRUG TREATMENT UNITS 
         Sec. 466.031.  DEFINITION. In this subchapter, "mobile
  unit" means a motor vehicle that is operated by a narcotic drug
  treatment program facility to provide services under the narcotic
  drug treatment program. 
         Sec. 466.032.  MOBILE UNIT REGISTRATION. (a) A facility
  that holds a permit under this chapter may operate one or more
  mobile units to provide services under a narcotic drug treatment
  program. 
         (b)  A facility must register each mobile unit with the
  department but is not required to obtain a separate permit for a
  mobile unit. 
         (c)  The executive commissioner may adopt rules setting a fee
  for registration of a mobile unit under this section.  The fee must
  be in an amount sufficient to recover the actual expenditures of
  state funds by the department to register and inspect the mobile
  units. 
         (d)  A mobile unit registered under this section is subject to
  inspection in the same manner as a facility inspection provided by 
  Section 466.025.
         Sec.  466.033.  SERVICES.  (a)  Notwithstanding any other
  provision of this chapter or any rule adopted under this chapter, a
  mobile unit may provide administrative, medical, and psychological
  service that are related to the narcotic drug treatment program's
  goals, including: 
               (1)  case management; 
               (2)  counseling; and
               (3)  physician examinations. 
         (b)  The mobile unit may collect samples, including but not
  limited to blood, saliva, or urine, for the purpose of narcotic drug
  testing or analysis. 
         (c)  The mobile unit may dispense or administer an approved
  narcotic drug for the maintenance or detoxification of persons with
  a drug dependency as part of a narcotic drug program permitted by
  the department.
         (d)  The mobile unit may provide the services described by
  Subsection (a) regardless of whether those services are provided or
  authorized to be provided in the narcotic drug treatment program's
  permitted facility.
         Sec. 466.034.  RULES.  The executive commissioner may not
  adopt a rule that limits a mobile unit to assisting or treating only
  established or stabilized patients.
         SECTION 2.  As soon as practicable after the effective date
  of this Act, the executive commissioner of the Health and Human
  Services Commission shall adopt rules necessary to implement the
  changes in law made by this Act.
         SECTION 3.  This Act takes effect September 1, 2023.
