A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the prohibition of tolls on portions of State Highway |
|
|
146 and State Highway 99. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Subchapter E, Chapter 228, |
|
|
Transportation Code, is amended to read as follows: |
|
|
SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL |
|
|
COLLECTION, AND [;] CONVERSION OF NONTOLLED STATE HIGHWAY |
|
|
SECTION 2. Subchapter E, Chapter 228, Transportation Code, |
|
|
is amended by adding Section 228.202 to read as follows: |
|
|
Sec. 228.202. TOLLS PROHIBITED ON PORTIONS OF STATE HIGHWAY |
|
|
146 AND STATE HIGHWAY 99. The department may not charge a toll, |
|
|
either directly or indirectly through an agreement with another |
|
|
entity, on: |
|
|
(1) the portion of State Highway 146 that crosses the |
|
|
Houston Ship Channel; or |
|
|
(2) the portion of State Highway 99 between its |
|
|
intersection with State Highway 146 and its intersection with |
|
|
Interstate Highway 10. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2023. |
