            |  | A JOINT RESOLUTION | 
         
            |  | proposing a constitutional amendment requiring this state to | 
         
            |  | observe daylight saving time year-round. | 
         
            |  | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
         
            |  | SECTION 1.  Article XVI, Texas Constitution, is amended by | 
         
            |  | adding Section 74 to read as follows: | 
         
            |  | Sec. 74.  (a)  This state shall observe daylight saving time | 
         
            |  | year-round throughout the state. | 
         
            |  | (b)  This section applies to all portions of the state, | 
         
            |  | regardless of time zone. | 
         
            |  | (c)  If a court finds this state is not authorized by federal | 
         
            |  | law to implement this section, Subsections (a) and (b) of this | 
         
            |  | section have full force and effect on the date the United States | 
         
            |  | Congress enacts legislation that becomes law that authorizes this | 
         
            |  | state to observe daylight saving time as prescribed by this | 
         
            |  | section. | 
         
            |  | SECTION 2.  This proposed constitutional amendment shall be | 
         
            |  | submitted to the voters at an election to be held November 7, 2023. | 
         
            |  | The ballot shall be printed to permit voting for or against the | 
         
            |  | proposition: "The constitutional amendment requiring this state to | 
         
            |  | observe daylight saving time year-round." |
