SENATE RESOLUTION
|
|
|
BE IT RESOLVED by the Senate of the State of Texas, 88th |
|
|
Legislature, Regular Session, 2023, That Senate Rule 12.03 be |
|
|
suspended in part as provided by Senate Rule 12.08 to enable the |
|
|
conference committee appointed to resolve the differences on |
|
|
Senate Bill 12 (the authority to regulate sexually oriented |
|
|
performances and to restricting those performances on the |
|
|
premises of a commercial enterprise, on public property, or in |
|
|
the presence of an individual younger than 18 years of age; |
|
|
authorizing a civil penalty; creating a criminal offense) to |
|
|
consider and take action on the following matter: |
|
|
Senate Rule 12.03(4) is suspended to permit the committee |
|
|
to add text on a matter not included in either the house or senate |
|
|
version of the bill in proposed SECTION 3 of the bill, by adding |
|
|
Section 43.28(a)(1)(E), Penal Code, to read as follows: |
|
|
(E) the exhibition of sexual gesticulations |
|
|
using accessories or prosthetics that exaggerate male or female |
|
|
sexual characteristics |
|
|
Explanation: The change is necessary to add additional |
|
|
conduct to the definition of sexual conduct. |
|
|
