No significant fiscal implication to the State is anticipated.
The bill would repeal the status offense of a child voluntarily running away from home and amend the definition of "missing child" in the Education Code to include such children. The bill would prohibit the detention of a child accused of only a status offense except in a nonsecure setting. The bill would prohibit a status offender, under any circumstances, from being placed in a post-adjudication secure correctional facility. It is assumed that any fiscal impact and any impact on state juvenile correctional populations or on the demand for state juvenile correctional resources would not be significant.
Local Government Impact
It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant. According to the Texas Education Agency, no fiscal implication to units of local government is expected with respect to the Education Code provisions of the bill.
