LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

March 14, 2023

TO:
Honorable Abel Herrero, Chair, House Committee on Corrections

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB252 by Johnson, Ann (Relating to the eligibility for an order of nondisclosure of criminal history record information of a criminal defendant who has successfully completed a specialty court program.), As Introduced

The fiscal implications of the bill cannot be determined due to the number of additional nondisclosure petitions that would be filed with the state court system being unknown.

The bill would expand the reach of nondisclosure order procedures for certain persons who successfully complete any specialty court program instead of those completing only a veterans court treatment program. The Office of Court Administration (OCA) anticipates this expansion will increase nondisclosure petitions filed with the court system, but cannot estimate what fiscal impact the increased filings will have on state courts due to the increased number of filings being unknown.

Local Government Impact

The fiscal implications to units of local government cannot be determined. OCA anticipates an increase in nondisclosure petitions filed with the court, but cannot estimate what fiscal impact the increased filings will have on local courts due to the increased number of filings being unknown.
