No significant fiscal implication to the State is anticipated.

The bill would increase the penalties punishable by fine for the offense of passing certain vehicles on a highway. The bill would increase the penalty to a Class A misdemeanor when the offense results in serious bodily injury to another and to a state jail felony in the case of a second or subsequent offense. The bill would authorize the court to suspended a person's driver's license in a case with a previous conviction for the offense and to discharge all or part of the fine or costs assessed by performance of community service. 

The Office of Court Administration and the Department of Public Safety anticipate no significant fiscal impact to the state. It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant. 

Local Government Impact

It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
