LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

April 2, 2023

TO:
Honorable Todd Hunter, Chair, House Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB984 by Capriglione (Relating to the employment of a chief privacy officer in the Department of Information Resources.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the executive director of the Department of Information Resources (DIR) to employ a chief privacy officer (CPO) to provide assistance to the state on legal and policy matters involving data privacy.

The bill would require each state agency to cooperate with the CPO in fulfilling statutory requirements, and authorize the CPO to assist local governments and the public with data privacy and protection concerns.

DIR currently employs an FTE that would fulfill all the duties outlined in the bill. It is assumed that any costs associated with the bill could be absorbed using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
