LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

May 19, 2023

TO:
Honorable Dade Phelan, Speaker of the House, House of Representatives

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB2454 by Guillen (Relating to the unlawful acquisition of certain weapons; creating a criminal offense.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would expand conduct constituting unlawful transfer of certain weapons to include acquiring a firearm with intent to deliver the firearm to a person knowing that such person is prohibited from possessing a firearm under state or federal law and make the offense punishable as a state jail felony.

It is assumed that any fiscal impact or any impact on state correctional populations or on the demand for state correctional resources would not be significant. While it is assumed that any state revenue impact would not be significant, it would be dependent on the number of offenses committed and the associated court costs.

Local Government Impact

It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
