Fiscal Analysis

The bill would amend the Occupations Code to establish the duties and responsibilities required of the Texas State Board of Dental Examiners (TSBDE) in order to participate in the Dentist and Dental Hygienist Licensing Compact. These duties and responsibilities include reporting standards that the TSBDE must meet, background check requirements, establishing compact privileges, and requirements of licensees to retain compact privileges.

This bill would be effective September 1, 2023.

Methodology

Based on the analysis of the TSBDE, this estimate assumes that the agency would require 3.0 additional full-time equivalent (FTE) positions to implement the provisions of the bill. An additional 2.0 License and Permit Specialist II FTEs (salary of $43,139 with estimated benefits of $13,731) would be needed to process additional applications and assist in the additional reporting requirements associated with being a compact participant state and an additional Investigator IV (salary of $55,096 with estimated benefits of $17,537) would be needed to handle additional complaints associated with compact privileges and licensees. Additionally, there is $28,991 in added annual costs to cover software licenses, share of space, phone access, and other operational costs and $13,350 in one-time start-up costs in fiscal year 2024.

Based on information provided by the Comptroller of Public Accounts, the additional revenue generated by the fee for license verification cannot be estimated at this time due to the participation rate being unknown. This analysis assumes that any increased cost to TSBDE authorized in the bill would be offset by an increase in fee-­generated revenue because TSBPE is statutorily required to generate sufficient revenue to cover its costs of operation.

Technology

This estimate assumes that the agency would need to updated their Versa database to account for the additional type of application and to track the applications within the compact. This would result in a one-time cost of $34,850 in fiscal year 2024.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
